Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BinB Mailer Pro mobile application and related services ("Service"). By installing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) and able to form a binding contract to use the Service.

2. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal or internal business purposes. You may not copy, modify, distribute, sell, or lease any part of the Service, or reverse-engineer or attempt to extract its source code, except where applicable law expressly permits otherwise.

3. Acceptable Use

You agree not to use the Service to:

  • Violate any law or third-party right, including intellectual property and privacy rights.
  • Generate content that is unlawful, harassing, defamatory, hateful, sexually explicit involving minors, or otherwise harmful.
  • Send spam, phishing, or fraudulent communications.
  • Interfere with, disrupt, or attempt to gain unauthorised access to the Service or its related systems.
  • Use the Service to develop a competing product or to train machine-learning models.

4. User Content

You retain ownership of the text you submit ("User Content"). You grant us a limited license to process User Content solely to provide the Service to you (for example, transmitting it to our AI provider to produce a rewrite and returning the result to your device). You are responsible for ensuring you have the right to submit any User Content.

5. AI-Generated Output

Rewritten output is generated by automated language models and may contain inaccuracies, omissions, or unintended phrasing. You are solely responsible for reviewing and editing output before sending it to any recipient or relying on it for any purpose. The Service is not a substitute for professional legal, medical, financial, or other expert advice.

6. Intellectual Property

The Service, including all software, designs, text, graphics, and trademarks, is owned by BinB Mailer Pro or its licensors and is protected by intellectual property laws. All rights not expressly granted to you are reserved.

7. Third-Party Services

The Service relies on third-party providers (including AI model providers). Your use of such third-party services may be subject to their own terms and policies, and we are not responsible for their actions or omissions.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY OUTPUT WILL BE ACCURATE OR SUITABLE FOR YOUR PURPOSES.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BINB MAILER PRO AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD 50.

10. Indemnification

You agree to indemnify and hold BinB Mailer Pro, its affiliates, and their respective officers, directors, employees, and agents harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or to protect the Service or its users. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

12. Changes to the Terms

We may update these Terms from time to time. We will indicate material changes by updating the "Last updated" date above. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles. Courts of competent jurisdiction in Nigeria will have exclusive jurisdiction over any dispute arising out of these Terms, unless otherwise required by applicable law.
